Awning Ace Limited provides access to this website in accordance with the following terms and conditions. By using this website and the features provided herein and/or by placing any orders with Awning Ace Limited, you agree to these terms and conditions of sale.

Legal governance

The Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.

For your extra peace of mind, all purchases are covered by our 30 day exchange or money-back guarantee (excluding any carriage charges incurred). If you change your mind for whatever reason, return the unused item(s) in their original packaging to Awning Ace Limited accompanied with the receipt/invoice and we will be pleased to offer you an exchange or refund - no hassles, for your total peace of mind. Please note that awnings, tents, shelters, and other outdoor equipment once pitched outside, are no longer in a perfect, unused resalable condition.

Guarantee

All new products are guaranteed against manufacturing defects for 12 months from the date of purchase unless otherwise specified. If a fault does occur during this period, we shall arrange to have the item repaired or replaced after it has been inspected. Any delivery charges will be met after inspection of the item.

Sometimes product specifications may change, in such instances, we’ll do our very best to inform you when placing your order. All our sizes and measurements are approximate but we do try to make sure they are as accurate as possible. No guarantee is given or implied that goods will conform in absolute detail to the description or illustrations published. Colour, size, and finish variations can occur between production batches and manufacturers.

Prices & VAT

All prices are displayed in £’s sterling and include VAT at 20%. The prices and terms & conditions set out on this website are correct at the time of publishing.  On the rare occasion where there is an error with product details or pricing, we will do our best to inform you at the earliest opportunity when your order is placed. It may be that prices and promotions are incorrectly quoted or changed due to external circumstances. We have no statutory obligation to sell goods at the price quoted. Prices found through search engines may not be accurate as they may include prices from older seasons, product lines, and promotions. All products are subject to availability.

Shipping cost.


Every effort is made to display the correct shipping cost for your purchase(s), however, some UK postcodes may attract additional courier costs, fuel duty charges, or additional fees outside of our control. As much as is possible, we try to absorb these charges but reserve the right to either pass on these additional costs (you will be notified in writing prior to your order being dispatched) or cancel your order and refund any monies paid. If you are unsure of your postage costs or would like a quotation for shipping, please contact us prior to ordering.

Contract cancellation

Please note that you are entitled to cancel this contract if you so wish provided that you exercise your right and notify us by email, no longer than 14 days after the day on which you receive the products.
If you wish to exercise your right to cancel this contract after your order has already been dispatched, we will refund the original purchase price and the cost of the standard delivery provided that you have notified us in writing no longer than 14 days after the day on which you receive the products and that you have taken reasonable care of the supplied products and not used them. Your return must be received back to us within 30 days.

User Registration/New Accounts/Guest Accounts

It is your responsibility to ensure that:
Any personal information you supply is true, accurate, current, and complete in all respects; and you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents, and suppliers, harmless immediately on demand, from and against all claims, liability, damages, losses, costs, and expenses, including reasonable legal fees, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your shopping account and/or your Personal Information.

Withdrawal of service

We reserve the right to modify or withdraw this Website (or any part thereof) without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or change the Conditions from time to time, and your continued use of the Website following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed.

Orders

Contract creation and electronic contracting

The technical steps required to create the contract between you and us are as follows:

  • You place the order for your products on the Website by completing the checkout process. You will be guided through the process of placing an order by a series of simple instructions on the Website.
  • We will send you an order acknowledgment email detailing the products you have ordered. This is not an order confirmation or order acceptance.
  • All new Camptech Full Awning are ordered and dispatched direct from Camptech Product Limited as a "special order item" unless otherwise stated on the individual product page/description.
  • As your product is shipped from our warehouse or third-party warehouse,  we will send you a despatch confirmation email.
  • Order acceptance and the completion of the contract between you and us will take place on the despatch to you of the products ordered unless we have notified you that we do not accept your order, or you have canceled it in accordance with written instructions.
  • Non-acceptance of an order may be a result of one of the following:
    • The product you ordered is unavailable from stock.
    • Our inability to obtain authorisation for your payment.
    • The identification of a pricing or product description error.
    • You not meeting the eligibility to order criteria set out in these Terms & Conditions.

International

Products delivered to some destinations, mainly outside the EU, may be subject to taxes, fees, levies or other charges, which are imposed by local legislation. The recipient of the products is responsible for all customs formalities for their export and import and will be required to pay any additional charges, including import duty, formal customs entry, taxes, levies, and other charges. The recipient of the goods, not the person who's ordered them, will receive a separate request for payment of these charges from our delivery agent.

If you're ordering products to be delivered to someone else, please make sure they're aware they'll be responsible for these additional charges. Unfortunately, we have no control over these charges and cannot predict what they may be, so we're unable to offer any assistance on these processes. We'd advise that you check the import charges applicable in any country before ordering products to be delivered there.

Part Delivery / Damaged Goods

All your goods should arrive in perfect condition, however, if you do receive any goods that appear to be faulty or damaged, the company must be advised within 72 hours of receipt. This applies to any items that may appear to be missing unless stated on the invoice that the item is currently out of stock. If any items are not to be used straight away, we strongly advise customers to check that these have been received in perfect condition and working order. The company will do everything possible to ensure your delivery arrives on time and intact, we will not accept responsibility for any additional expenses that occurred due to late or incomplete deliveries. Please carefully check all awnings, tents, and outdoor equipment before you embark on your holidays.

Returns

IMPORTANT
Caravan, Motorhome, and Campervan Awnings Returns

Please note that any awning sizes provided by Awning Ace Limited are based entirely on the customer's supplied vehicle/caravan specification. We can only advise on your awning size based on unmodified UK specification vehicles. The correctly supplied awning size does not guarantee the product will fit your vehicle. Some modern caravans require additional awning rail adapters, brackets of fittings. Please see your caravan owners manual for further detail, or discuss your concerns with our staff before ordering your awning. Awning Ace Limited does not accept any responsibility whatsoever in the event that customers order the wrong size awning for their vehicle. Always keep all the original packing materials, including the supplied shipping box. Once the awning is taken out of the packaging and/or erected upon the caravan or motorhome (tried on for size), the product is deemed as being used and Awning Ace Limited will no longer accept the goods back for exchange/refund/return unless there is an obvious manufacturing defect, which needs to be documented and/or photographed by the customer before attempting a return request. Always make sure you have ordered the correct size awning for your vehicle as the final purchase decision remains entirely with you, the customer. This policy does not affect your statutory rights (such as your rights under the Sale of Goods Act 2015)

Camptech Seasonal, All Season & Touring Awnings (Special Orders)

The following terms and conditions apply to Camptech Special Order awning products (not supplied from our stock) direct from Camptech Products Limited.

Ensure you order the correct size awning for your caravan or motorhome. Awnings which have been ordered in the wrong size will no longer be accepted as a return for exchange or refund. These items will only be accepted should a manufacturing issue be identified. Manufacturing faults MUST be reported to Awning Ace Limited using a fully completed Camptech Inspection Report (supplied on request), together with supporting photographic images clearly identifying the claimed fault. Camptech will not process any warranty claims without a completed inspection form and supporting images. Once received Camptech will arrange collection of your item(s) which must be made available within 14 days of the reported issue. Standard turnaround for inspections by Camptech is 21 working days from receipt. Collections will normally be made by DHL between 8am and 8pm. There must be a responsible person available for this collection. We are unable to provide an exact collection time, only the date that the collection has been scheduled to take place. You are responsible for ensuring that the parcel is packaged in a suitable cardboard box and is securely fastened. We will not accept any returns that are not securely packaged as our courier will refuse collection.

Return process

We understand that from time to time you may wish to return products to us in appropriate circumstances. This Returns Policy applies to customers irrespective of their geographical location. This policy does not affect your statutory rights (such as your rights under the Sale of Goods Act 2015)

Consumer Contracts Regulations 2013/Sale of Goods Act 2015

Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. These apply to sales of goods or services to consumers without face-to-face contact. This includes selling by mail order, through the internet, or by telephone, fax, or text message.

E-commerce regulations

The E-Commerce Regulations apply to any sales made electronically: for example, using email, through your website, or via phone texts. The regulations apply to sales to businesses as well as to consumers. (Distance sales to consumers using electronic means are covered by both the E-Commerce Regulations and the Consumer Contracts Regulations.)

Please note that your right to return products does NOT apply to Products that fall into the following categories unless they are faulty or not as described:

  • Made to measure, specially ordered items or personalised goods
  • Perishable goods (such as food or bait)
  • Unsealed CDs, DVDs, tapes, or other recording media, software, or videos

Unwanted items

Your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013/Sale of Goods Act 2015: You have the right to return your purchase for a refund within 30 days. You are responsible for paying return postage costs for unwanted items. Items must be returned unused, in a re-saleable new condition in together with all their original packaging. Please note that awnings, tents, shelters, and other outdoor equipment once pitched outside, are no longer in a perfect, unused resalable condition and will not be eligible for a refund unless faulty. Upon receipt of the returned goods, we will aim to process your refund/exchange as quickly as possible (optional express delivery charges selected at checkout will not be refunded). 

Faulty Goods

All purchases should be checked fully within 14 days of the purchase date and certainly before your camping holiday. Tents and awnings should be checked before embarking on your first trip. In the unlikely event that you will need to return your purchase due to a manufacturing fault, or it is damaged or the wrong item, we may organise collection and exchange for you. If you wish to return the faulty item by post or your own courier we will reimburse the cost up to a pre-agreed amount. Your goods MUST be packaged adequately for transport in a cardboard box or other suitable packaging. The responsibility for the safe return of purchased goods remains with you until received by a member of our staff. Please use an insured courier service for your own protection.

Returns Procedure

All goods returned must be clearly labeled and have full documentation enclosed including the reason for return - a returns form is available here to be completed with your return. All returnable goods must be reported to Awning Ace Limited in writing (an email is acceptable) prior to returning any items. Goods returned without any notice will not be accepted. Express carriage charges are non-refundable unless goods are faulty or have a manufacturing defect. All other goods must be returned at the sender's expense. If required, (only for larger items), Awning Ace Limited offers a collection service at a charge of between £25.00 to £75.00 per parcel (up to a maximum of 30kg) from addresses in the Mainland UK. For collection from other locations/countries/heavy items, please call for a quote. Items which have been opened and/or used, items which you have had for 30 days or more, and items which are under a warranty claim, must be returned at the buyers expense unless authorised by either the manufacturer or Awning Ace Limited. Return shipping costs for warranty claim items will be refunded should a manufacturing fault be identified up to a maximum £25.00. Proof of return delivery cost will need to be provided before shipping cost refunds can be issued, so please ensure you obtain a receipt.  

If you are returning a caravan or motorhome awning, please note the following:
a) Your awning must be clean and dry. It is your responsibility to ensure the item is packaged in a cardboard box or other suitable packaging suitable for safe transport. Failure to do this will result in the couriers refusing to collect the item, or us sending the item back to you unprocessed. Redelivery to you will, under these circumstances, be at your cost and must be paid for in full before despatch.  

b) In some instances it may be necessary to send your returned item to the manufacturer for inspection - please allow up to 21 days for them to process these returns. Naturally, we will keep you informed of any delays together with updates on our investigations. Awning Ace will coordinate with the product manufacturers on your behalf and all communications should be maintained through Awning Ace and not directly with the product manufacturer. This is our legal responsibility.

c) Please include a completed return form including a full description of the fault together with photos of the fault with your item, along with a copy of your original receipt/invoice to enable us to identify and process your return as quickly as possible.

d) If your awning is deemed by us or the manufacturer not to be faulty, we reserve the right to dispatch your item back to you at your cost. Failure to respond to our updates within 5 working days will result in us arranging the return of your item without further notice.

e) Items returned incomplete, without suitable packaging, without fault, with missing parts, damaged through misuse, accidental damage, storm damage, wind damage, extended UV exposure, wet and/or dirty, will be notified to the customer and returned at you at your expense. Failure to make payment for customer returns, supply the missing items, or provide additional supporting evidence will result in item(s) being held securely in our warehouse for 60 days before being disposed of. Where possible we use local recycling services to minimize the impact on our environment.

We reserve the right to charge a repacking/cleaning fee on items that have been returned soiled or unpacked. Items that have been opened, pitched, used, or not in new condition will attract up to a 50% reduction in your original purchase amount. All awnings, and fabrics must be in clean and dry condition; we reserve the right to reject products or charge a £250.00 cleaning fee. For your own peace of mind and security, we recommend using an insured courier service as the responsibility for the return of your items remains with you until a member of our staff has signed for the item.

Refunds

Where applicable, Awning Ace Limited will send you a refund for the full price of any product properly returned by you in accordance with the terms of this returns policy. We will usually refund any money received from you using the same method originally used by you to pay for your purchase. We will process the refund due to you as soon as possible and, in any event, within 30 days of the day, we received your returned product. Orders with "Priority Express Delivery" or "Heavy Express Delivery" options selected at checkout will not receive a refund for their delivery costs unless the item has a manufacturing defect.

Promotional discounts

Coupons, discounts and promotional discount codes offered on our website, email or social media campaigns are valid only for use as part of a purchase made via https://www.awningace.com, unless otherwise stated. 

Factory Second/Store Returned/Clearance Sales:

These are items that have been identified as such and discounted accordingly. These products will be available in limited quantities, sizes, and colours. When stock runs out we will no longer be able to supply that item at the special offer price. Nor will we be able to offer exchanges after the stock has run out. Carriage charges are non-refundable unless goods have additional manufacturing faults not described in the individual item description. Factory seconds and store returns are obviously not new items and should only be purchased on this understanding. All these items are pitched and inspected at our own indoor warehouse and fully documented before being offered for sale. They are supplied with a six (6) months guarantee direct from our stores.

General

Intellectual property and the right to use

You acknowledge and agree that all copyright, trademarks, and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorised by us.

You acknowledge and agree that the material and content contained within the Website are made available for your personal non-commercial use only and that you may (if necessary to make a Purchase) download such material and content onto only one computer hard drive for such purpose.

Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content. We will in all cases seek to enforce and prosecute to the full extent of the law, all breaches of our IPR, TM, and Copyright materials including images, graphics, text, descriptions, blog posts, and know-how.

Limitation of liability

While we will use reasonable endeavors to verify the accuracy of any information we place on the Website, we make no warranties, whether express or implied in relation to its accuracy. The Website is provided on an "as-is "and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the Website, or any transaction that may be conducted on or through the Website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from a course of dealing or usage or trade.

We make no warranty that the Website will meet your requirements or will be uninterrupted, timely, or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the Website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the Website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the Products. This does not affect your statutory rights as a consumer, nor does it affect your Contract Cancellation Rights.

We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations), or otherwise out of or in connection with the Conditions for:
any economic losses (including without limitation loss of revenues, profits, contracts, business, or anticipated savings); or
any loss of goodwill or reputation; or
any special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under the Conditions.

Nothing in the Conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents, or employees.

Severance

If any part of the Conditions shall be deemed unlawful, void, or for any reason is unenforceable, then that provision shall be deemed to be severable from the Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Conditions.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of the Conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

These Conditions govern our relationship with you. Any changes to these Conditions must be in writing and signed by both parties. You confirm that, in agreeing to accept the Conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these Conditions and you agree that you shall have no remedy in respect of any representation. Your Statutory Rights are not affected by these terms and conditions. Nothing in this Clause shall limit or exclude our liability in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Conditions.

Statutory Rights

These terms and conditions do not affect your statutory rights as a customer.
